The former personal attorney for Donald Trump has left her position as New Jersey's top federal prosecutor. This decision was prompted by a judicial decision that questioned her right to occupy the role.

Official Departure

US Attorney General, the Attorney General, announced the prosecutor's departure on Monday. She commented that the appeals court finding made it "untenable" for her to lead the department effectively.

"But do not mistake compliance for surrender," Habba stated. "This battle will now reach across America."

Legal Background

Habba's exit comes a week after a US appeals court determined that she had been unlawfully serving as US attorney. This judgment is likely to affect numerous criminal cases in the Garden State.

The court said that a interim role that skirted confirmation by the US Senate ran afoul of the Federal Vacancies Reform Act.

Ongoing Legal Battle

The Attorney General added that Habba will continue working within the justice department as a senior adviser. Habba plans to seek further review of the court's action, with hopes of a reversal.

In a statement, the Attorney General argued that judges "must not override the President's choice of lawyers tasked with executing the fundamental role of the presidency of prosecuting crime."

The 41-year-old attorney, originally became part of the former president's legal defense in recent years. She later acted for her client in his business records case in the previous year, when he was conviction on 34 counts of document fraud.

Before assuming the federal prosecutor position, Trump had revealed he was selecting her as his senior adviser if re-elected, calling Habba as "unwavering in her loyalty" and a "tireless advocate for justice".
